1. Acceptance of Terms

By accessing or using OKX services ("Services"), including our website, mobile applications, APIs, and trading platform, you agree to be legally bound by these Terms of Service ("Terms") and all applicable laws and regulations.

If you are using the Services on behalf of an entity, you represent that you are authorized to bind that entity to these Terms. These Terms constitute the entire agreement between you and OKX regarding your use of the Services.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use OKX Services. The Services are not available to residents of restricted jurisdictions including the United States, China, North Korea, Iran, or other OFAC-sanctioned territories.

By using the Services, you represent and warrant that you meet all eligibility requirements. OKX reserves the right to refuse service to anyone for any reason at any time.

3. Account Registration and Security

To access most Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update your information to keep it accurate.

You are solely responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must immediately notify OKX of any unauthorized use of your account.

OKX will never ask for your password or seed phrase. Any communication asking for these is fraudulent.

4. Know Your Customer (KYC) and AML

OKX is required by law to verify the identity of its users. You agree to complete identity verification as required and to provide truthful documentation. Failure to complete KYC may result in restrictions on your account.

OKX operates in compliance with global anti-money laundering (AML) and counter-terrorism financing (CTF) regulations. We may report suspicious activity to relevant authorities without notifying you.

5. Trading and Financial Services

Cryptocurrency trading involves substantial risk of loss. Past performance is not indicative of future results. You acknowledge that you are solely responsible for your trading decisions and any resulting losses.

OKX is not a financial advisor. Nothing on our platform constitutes investment advice. You should seek independent financial advice before making investment decisions.

Margin trading and derivatives products carry significant risk and may not be suitable for all users. You may lose more than your initial investment.

6. Fees

OKX charges fees for certain Services, including trading fees, withdrawal fees, and other service-specific fees. Current fee schedules are available on our Fees page. OKX reserves the right to modify its fee structure with 7 days notice.

7. Prohibited Activities

You may not use OKX Services for any unlawful purpose, to manipulate markets, to engage in wash trading, to circumvent AML controls, to create multiple accounts, to reverse-engineer our platform, or to violate any applicable law or regulation.

Violation of these prohibitions may result in immediate account suspension, asset freezing, and referral to law enforcement authorities.

8. Intellectual Property

The OKX platform, including all logos, designs, software, and content, is owned by OKX or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, or create derivative works from our content without express written permission.

9. Disclaimers and Limitation of Liability

The Services are provided "as is" without warranties of any kind. OKX disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, OKX's total liability to you for any claims arising from your use of the Services shall not exceed the fees you paid to OKX in the twelve months preceding the claim.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Seychelles, without regard to conflict of law principles.

Any disputes shall first be submitted to mediation. If unresolved, disputes shall be settled by binding arbitration in accordance with UNCITRAL Arbitration Rules. Class action waiver: you waive any right to bring claims as part of a class action.
